To the fullest extent permitted by applicable law, Douglas Simons shall not be liable for any damages of any kind arising out of or in connection with your access to, use of, or inability to use this website or its content. This includes, without limitation, any direct, indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages.

This limitation of liability applies to, without limitation:(i) your use of or reliance on any content or services provided through the website; and(ii) any errors, omissions, or performance issues related to the website or its functionality.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, liability shall be limited to the maximum extent permitted by law.


Indemnification

You agree to defend, indemnify, and hold harmless Douglas Simons from and against any and all claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of this website or your violation of these Terms of Use.

Terms and Conditions of Service

Douglas Simons Pressure Washing & Cleaning Services

Thank you for choosing Douglas Simons for your exterior cleaning needs. To ensure a clear understanding between both parties and to maintain a high standard of service, please review the following Terms and Conditions carefully before any pressure washing, exterior cleaning, or restaurant cleaning services are performed on your property.


1. Electrical Safety

Douglas Simons will not clean near any exposed electrical lines, junction boxes, or incomplete electrical work. These areas will be skipped during service unless we have confirmed otherwise in writing prior to the job. This policy protects both your property and our technicians.


2. Property Condition and Waterproofing

Douglas Simons provides exterior pressure washing services using high-output equipment that sprays water and mist onto surfaces. Unless otherwise noted, it is assumed that all exterior surfaces of your home or business are watertight and designed to withstand exposure to the elements.

We are not responsible for water intrusion or damage resulting from pre-existing issues such as:

  • Non-waterproof materials or fixtures

  • Leaking windows, doors, trim, thresholds, vents, or siding

  • Cracked or compromised seals

If you are aware of any potential air or water leaks, you must notify us before work begins. We will assess whether protective measures can be taken or whether the service should be declined to prevent possible damage.


3. Worksite Cleanliness

Douglas Simons will leave the work area clean and free of debris. Windows will be rinsed (not squeegeed), and surfaces will be swept as part of standard completion.


4. Payment Terms and Late Fees

All invoices are due upon receipt with a discounted rate valid for payment within seven (7) calendar days (“Net 7”).

Payments made after 7 days are subject to the following rate adjustments:

  • 7–15 days: +10%

  • 15–30 days: +15%

  • 30–45 days: +20%

  • 45–60 days: +25%

  • Over 60 days: +35%

Delayed payments limit our ability to accept new work due to labor and material costs. 

5. Guarantee

Many surfaces contain pre-existing staining, oxidation, mineral intrusion, rust, organic growth shadowing, embedded contaminants, or permanent discoloration. These conditions may not be fully removable by any cleaning process without risking damage to the surface.

Client agrees that Douglas Simons makes no guarantees regarding total stain removal, complete uniformity, or “like new” appearance. The goal of cleaning is improvement, not perfection.


6. Insurance Certificates, Insurance Portals & Payment Portals

Douglas Simons is fully insured. Certificates of insurance and additional insured endorsements are available upon request at no charge.

Our existing insurance coverage meets the requirements for virtually all clients and properties we have serviced over the past 40+ years.

Any additional insurance requirements—including documentation, endorsements, administrative processing, or increased coverage limits—must be disclosed prior to estimating or before the project begins. Any associated costs, time, or fees will be added to the final invoice and must be approved by the client in writing before proceeding.

If additional insurance requirements are introduced after the estimate has been provided or after the project has been completed and were not disclosed in advance, all associated costs, time, and fees will still be added to the final invoice and remain the responsibility of the client.

 

 

Insurance Portals, Payment Portals, Registration Fees & Administrative Charges

If a client requires participation in any third-party insurance portal (COI management system), payment portal, invoicing system, or vendor-management platform in order to receive payment or meet compliance requirements, all associated costs will be added to the total price of the job.

Such requirements must be disclosed before the project begins. Any associated costs, time, or fees—including setup, processing, or administrative work—must be approved by the client in writing prior to proceeding.

If these requirements are introduced after the project has been completed and were not disclosed in advance, all associated costs, time, and fees will still be added to the final invoice and remain the responsibility of the client.

This includes, but is not limited to:

  • Portal membership, onboarding, or registration fees
  • Certificate request or compliance processing fees
  • Per-transaction, service, or processing fees
  • Time spent on account setup or vendor onboarding
  • Portal navigation, submissions, and required steps
  • Form completion, compliance verification, or documentation uploads

All additional charges—both time and fees—will be itemized on the final invoice.

 

 


7. Waiver of Lien

A final waiver of lien will be provided free of charge upon request.
If a notarized copy is required, an additional fee of $150 plus postage will apply to cover administrative and notary costs.


8. Post-Service Inspection

The property owner or manager must inspect all completed work within three (3) hours of job completion.
We cannot accept responsibility for any damage or issues reported after that time frame, as water exposure may cause subsequent changes that are outside our control.


9. Water Access

The client agrees to provide access to a functional water source at the service location unless otherwise noted in writing before work begins.


10. Trip Charges and Readiness

Our operational calendar is limited by weather conditions. If we arrive to perform scheduled work and the site is not ready, a $150 trip charge will apply.
Depending on the service agreement, additional minimum charges may apply (typically $150 trip fee plus $195 per hour, with a 3-hour minimum).


11. Collection Costs

Any costs incurred by Douglas Simons to collect unpaid invoices—including legal fees, collection agency costs, and administrative time—will be the responsibility of the customer.


Acknowledgment

By commissioning Douglas Simons to perform pressure washing or cleaning services, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
